Article 2 – Purpose
These General Conditions of Sale aim to define the contractual relationship between the seller and the buyer and the conditions applicable to any purchase made through the seller’s merchant site, whether the buyer is a professional or a consumer.
The acquisition of a good or a service through this site implies unreserved acceptance by the buyer of these General Conditions of Sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly approved by the seller.
The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Article 3 – Characteristics of the goods and services offered
The products and services offered are those listed in the catalog published on the seller’s website https://eu.bamcases.com.
These products and services (Sale of cases and accessories for iPhone and Samsung, leather goods, etc.) are offered within the limits of available stocks.
Each product is accompanied by a detailed description drawn up by the seller (product description, reference, price including tax, photos).
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product, particularly with regard to colors.
All images are subject to change. Bam is not responsible for minor modifications or upgrades to the case which are slightly different from the picture.
Article 4 – Rates
The prices appearing in the catalog are prices including VAT in euros taking into account the 20% VAT applicable on the day of the order (except for protective masks which have a rate of 5.5%); any change in the rate may be passed on to the price of the products or services.
The seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. Payment of the full price must be made when ordering. At no time can the sums paid be considered as a deposit or down payment.
The prices indicated do not include order processing, transport and delivery costs provided that they take place in the geographical areas provided for below.
Article 5 – Geographical area
The online sale of the products and services presented on the site https://eu.bamcases.com is offered in:
Metropolitan France and overseas departments:
Metropolitan France, Monaco and Corsica, as well as the French overseas departments (DOM): Guadeloupe (GP), Guyana (GF), Martinique (MQ) and La Réunion (RE), as well as the two French overseas communities of Saint-Martin and Saint-Barthélemy.

Article 6 – Orders
The buyer, who wishes to buy a product or service must:
– complete the identification form on which he will indicate all the requested details (e-mail address, password, civility, surname, first name, date of birth, company, address, postal code, city, country, telephone number) ;
– complete the online order form by putting the referenced items in his “basket”;
– validate his order after having checked it;
– make the payment under the conditions provided;
– confirm their order and payment.
Confirmation of the order entails acceptance of these General Conditions of Sale, acknowledgment of having perfect knowledge of them and waiver of the right to invoke its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.
The seller will communicate by e-mail confirmation of the registered order.
Article 7 – Terms of payment
The price is payable when ordering.
Payments will be made via the secure payment system Paypal or credit card.
The buyer’s account will only be debited for the amount of the products or services chosen and ordered.
At the request of the buyer, he will be sent, by post, a paper invoice showing the VAT. This invoice can be downloaded at any time from the customer’s account.
Article 8 – Preparation of the order and Delivery
Once the buyer has paid for his order via his credit card, he will receive in his mailbox (on the email indicated during registration and validation of the order) a confirmation of payment.
The seller then undertakes to ship the buyer’s entire order within 24 to 48 hours from Monday to Friday (depending on the number of orders).
From Monday to Friday, if the buyer places an order before noon (12 noon), the seller will be able (depending on the number of orders to be prepared) to prepare the order and ship it the same day.
From Monday to Friday, if the buyer places an order after noon (12 noon), the seller will be able (depending on the number of orders to be prepared) to prepare the order and ship it within 2 working days.
All orders placed on Saturday and Sunday will be dispatched by the seller on the following Monday or Tuesday.
Deliveries are made to the address indicated in the order form which can only be in the geographical area agreed in article 5.
For Metropolitan France, the shipment is provided by La Poste, in Priority Letter. The indicative delivery time for sending a Priority Letter is 3/4 working days according to the delivery times of La Poste (indicative time).
The risks are borne by the purchaser from the moment the products have left the seller’s premises. In the event of damage during transport, the reasoned protest must be made to the carrier within four days of delivery.
Delivery times are only given as an indication; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.
And in the event that the buyer orders several products, one of which has a longer manufacturing time than the others, the seller reserves the right to send the order at once at the longest time.
The delivery address is to be checked very carefully by the buyer. Under no circumstances will the seller be held responsible for the non-delivery of an order if a detail of the address is incorrect.
If the address or the name of the person linked to the delivery address is incorrect, or if nobody is here to pick up the package and if the order is returned to the sender, the seller then undertakes to inform the buyer. The seller’s only choice will be to reship the order to the correct address. The buyer then agrees to repay the shipping costs to the seller.
Article 9 – Site security
With regard to the website https://eu.bamcases.com, we cannot guarantee the absence of viruses or a technical defect or inaccuracy of the site.
Article 10 – Liability
The seller, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
Article 11 – Intellectual property
All elements of the seller’s site are and remain the exclusive intellectual property of the seller.
No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.
Any simple or hypertext link is strictly prohibited without the express written consent of the seller.
Article 12 – Settlement of disputes
These General Conditions of Online Sale are subject to French law.
In the event of a dispute, jurisdiction is assigned to the competent courts of Lisieux, notwithstanding multiple defendants or warranty claims.
We strongly advise all musicians to contact their insurance company to add their case to their instrument insurance policy, to cover any accidents that may occur.
Article 13 – Return of goods
All merchandise purchased from BAM has a 14 day return policy. If you change your mind, you have 14 days to contact us and return your item to us in new condition, in its original packaging, with all accessories and with the correct form completed (RETURN FORM) to obtain a full refund. If not, after inspection, the return will be refused or you will get a partial refund. You will be responsible for return costs unless your product is faulty or was shipped in error: shipping method to be discussed with BAM France.
All faulty goods purchased from BAM, within the first 14 days from the date of purchase, will be repaired or exchanged at our discretion. Once the article has been confirmed as defective, a return can be arranged in agreement with BAM France.

If the case is damaged in transit, claims must be notified to BAM within 10 days. A claim will be filed with the shipping company. Please document the damage and retain all original packaging for the claim period.
